The terms
How this website and my services work, in plain English. If you and I sign a written agreement for your project, that agreement wins wherever it says something different.
Last updated October 13, 2026.
Higgins Graphix is operated by Bishop Higgins, an individual doing business in Cleveland, Tennessee. In these terms “I” and “me” mean Higgins Graphix, and “you” means the person using this site or hiring me. By using the site or hiring me, you agree to these terms.
Using this website
The information here
I work to keep the prices and details on this site accurate, but it can contain mistakes and I may change it at any time. Prices shown are my standard prices on the day you read them. Your price is the one in the written quote I send you before any work starts.
Timeframes on this site, such as replying within 24 hours or having a site live in 5 to 7 days, are what I aim for and usually meet. They are not guarantees.
Who owns what is on it
The wording, design, code, logo and video on this site belong to Higgins Graphix. The site was built with AI tools under my direction. Client work is shown with the client's permission, and their names and logos belong to them. You are welcome to look around and share links. Please do not copy or reuse the design or content without asking me first.
Using the site fairly
Do not try to break, probe or overload the site, copy it in bulk, or send spam or false information through the quote form.
Links elsewhere
This site links to other websites, including my clients' sites and Google. I do not control them and am not responsible for what is on them.
No warranty
The site is provided as it is. To the fullest extent the law allows, I make no warranties about it and I am not liable for losses that come from using it or from not being able to use it.
Working with me
These terms apply to every project unless your written quote or a signed agreement says otherwise.
The quote is the deal
Before any paid work starts I send you a written quote saying what I will make and what it costs. Anything outside that quote gets its own price before I do it.
You bring the facts, I make the content
I am not an expert in your trade. You tell me what you want to say, and I make it look and sound good. You are responsible for the accuracy of everything you ask me to say about your business, including prices, offers, claims, qualifications, licence numbers and any health, safety or legal statements. I do not check them.
You confirm that you have the right to use everything you give me, such as photos, video clips, logos, wording and music.
People and places on camera
You are responsible for making sure that everyone who can be recognised in a photo or video, including employees and customers, has agreed to appear, and that I have permission to film wherever we are filming. For anyone under 18, that agreement has to come from a parent or guardian. Tennessee law gives people rights over the commercial use of their name, image and voice, so I may ask for signed releases before I film.
Approval and posting
Nothing is final until you approve it. You post content to your own accounts yourself, and I do not access them. Once you publish something, what appears on your pages is your responsibility.
What I may turn down
I may decline to make or use anything I believe is false, misleading, unlawful, hateful, or likely to infringe someone else's rights.
Websites
- The demo is free and you are under no obligation after seeing it. The demo and its code remain mine until the site is paid for.
- Payment is due when the site goes live. For builds over $1,000, half may be due once you approve the demo.
- Two rounds of changes are included. Further changes are quoted first.
- Domain names and hosting are kept in your name wherever possible, and their fees are yours to pay unless your quote says otherwise.
- I do not guarantee any position in search results.
Retainers
- Retainers run month to month and are billed at the start of each month.
- You can cancel any time. Tell me before the 1st and that month does not happen.
- A month that has started is not refunded. You still receive everything made for it.
- Work included in a month that you do not use does not carry over to the next month unless I agree in writing.
- I film within a two hour drive of Cleveland, Tennessee. Visits more than an hour away carry a $50 travel fee each.
- If a filming visit has to move because of weather, illness or something on your side, we find another time.
One-off projects and printing
- Payment for a one-off project is due when I deliver the finished piece, unless your quote says otherwise.
- My prices are for design work. Printing is billed at the printer's price with nothing added.
- You approve a proof before anything goes to print. After that, mistakes in the approved proof and faults in the printing are not my responsibility.
Music, fonts and stock material
I only use music, fonts and stock material that I am licensed to use in content for a business. If you ask for a particular song, image or font, arranging the licence for it is up to you.
How the work is made
I use AI software as a tool in my work, and it plays a significant role. That includes writing the code for websites and helping with wording, design and editing. I decide what gets made, direct it and approve it before you see it, and I am responsible for what I deliver to you.
Under current United States copyright rules, material produced by AI tools may not be protected by copyright in the same way as work made entirely by a person. What passes to you under the next section is every right I hold in the finished work.
Who owns the finished work
Once you have paid in full, you own the finished work I delivered: the final videos, posts, designs and website files. I keep the raw footage, working files, drafts and anything that was not used. Fonts, music, stock material and code libraries inside the work stay under their own licences.
I may show finished work in my portfolio, on this site and on my own social media, unless you ask me in writing not to.
Results
I do not promise any particular number of followers, views, enquiries, sales or search ranking. Nobody honestly can.
If something goes wrong
If I make a mistake in the work, tell me and I will fix it at no charge. If an invoice goes unpaid, I may pause work until it is settled, and ownership of the work passes to you when it is paid for.
To the fullest extent the law allows, the most I can owe you for any claim connected to a project is the amount you paid me for that project, or for a retainer, the amount you paid in the three months before the problem arose. I am not liable for lost profits or other indirect losses. Nothing in these terms limits any liability that the law does not allow to be limited.
Keeping things private
I keep what I learn about your business private, apart from the finished work I am allowed to show.
Independent business
I work as an independent business, not as your employee.
Which law applies
These terms are governed by the laws of the State of Tennessee. If we cannot settle a disagreement by talking it through, it will be heard in the state courts of Bradley County, Tennessee, or the federal court that serves Bradley County.
Changes to these terms
I may update these terms. The version posted on the date of your quote is the one that applies to that project.
Reviews and testimonials
Any review or testimonial shown on this site comes from a real client and is in their own words. I never pay for reviews, and I never offer a discount or anything else in exchange for a Google review. If a testimonial on this site came from a client who received a reduced rate, it says so.
Accessibility
I want this site to work for everyone. It is built to be used with a keyboard and a screen reader, with real headings, text alternatives for images, readable contrast and a pause button on moving video, and I aim to meet the WCAG 2.1 AA guidelines.
If any part of it does not work for you, email HigginsGraphix@gmail.com and tell me what went wrong. I will get you the information another way and fix the problem.
